RIGHT OF WITHDRAWAL
Pursuant to the provisions of Royal Legislative Decree 1/2007 of 16 November, approving the revised text of the General Law for the Protection of Consumers and Users and other supplementary laws, the consumer has the right to withdraw from a distance contract (by telephone, internet, postal mail, fax, at their home, etc.) within 14 calendar days without the need for justification.
The withdrawal period will expire 14 calendar days from the day of the conclusion of the contract, or, as applicable, from the day on which you or a third party indicated by you, other than the carrier, acquired material possession of the goods, or of the last of those goods purchased, or of the last of the pieces of a single good acquired in the same order.
To exercise the right of withdrawal, the consumer must notify their decision to withdraw from the contract by means of an unequivocal statement (for example, a letter sent by postal mail, fax, or email). You may use this model withdrawal form, although its use is not obligatory. The user also has the option to complete and submit electronically the model withdrawal form or any other unequivocal statement through the website indicated in the header of this form. By choosing this option, the consumer will promptly receive, on a durable medium (for example, by email), acknowledgement of receipt of such withdrawal. To meet the withdrawal deadline, it is sufficient that the communication concerning the exercise of this right is sent by the consumer before the relevant period has expired.
The exercise of the right of withdrawal shall extinguish the obligations of the parties to perform the contract or to conclude it when the consumer has made an offer. Therefore, if the mentioned conditions are met, I will reimburse you for all payments received, including, where applicable, delivery costs, without undue delay and, in any case, no later than 14 calendar days from the date on which the consumer’s decision to withdraw from the contract was received. Such reimbursement shall be made using the same means of payment you employed for the initial transaction, unless you have expressly agreed otherwise and provided that you do not incur any expenses as a result of the reimbursement.
The right of withdrawal does not apply to the contracts referred to in Article 103 of Royal Legislative Decree 1/2007 of 16 November, approving the revised text of the General Law for the Protection of Consumers and Users and other supplementary laws.
